Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Easy Recharge mobile app, website (easyrecharge.ng), and related services (together, the "Service"), operated by [Easy Recharge Legal Entity Name] (RC [RC number]) ("Easy Recharge", "we", "us", or "our"), with registered address at [registered address].

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who We Are (and What We Are Not)

Easy Recharge is a reseller of digital top-up and bill-payment services. We let you buy airtime, data, cable TV subscriptions, prepaid electricity tokens, exam result-checker PINs, broadband plans, betting-wallet funding, and bank transfers from third-party providers, conveniently from one place.

Important: Easy Recharge is not a bank, deposit-taking institution, or licensed financial institution. We do not take deposits, provide escrow, hold funds in custody for safekeeping, pay interest, or offer any form of insured savings. Your wallet (described below) is a prepaid spending balance used only to pay for the services we resell. All card and bank-transfer payments are processed by a licensed third-party payment partner, not by Easy Recharge.

2. Eligibility

To use the Service, you must:

  • be at least 18 years old (or the age of majority in your state of residence);
  • be able to form a legally binding contract under Nigerian law;
  • provide accurate registration information and keep it up to date; and
  • use the Service only for lawful purposes.

Certain services have their own age or eligibility rules set by the underlying provider (for example, betting-wallet funding is restricted to persons of legal betting age). You are responsible for meeting those rules.

3. Your Account

You register using your phone number and/or email and any verification steps we require. You are responsible for:

  • keeping your login credentials and device secure;
  • all activity that happens under your account; and
  • notifying us promptly at [support email] if you suspect unauthorised access.

We may require identity verification (KYC) consistent with applicable Nigerian regulatory expectations before enabling or increasing certain limits. We may decline, limit, or close accounts where verification is incomplete or where we reasonably suspect fraud or misuse.

4. Your Wallet (Prepaid Spending Balance)

Your wallet is a prepaid balance that you fund in advance and then spend on the services we offer. To be clear:

  • The wallet balance is stored value for buying the listed services only — it is not a bank deposit and is not insured.
  • We do not pay interest on wallet balances.
  • Wallet funds are not transferable to cash except through the bank-transfer service we expressly offer, and subject to its limits and fees.
  • You fund your wallet by debit card or bank transfer, processed by our licensed third-party payment partner. We do not store full card details.

We may set minimum/maximum funding amounts, per-transaction limits, and daily limits, and may adjust them for security or regulatory reasons.

5. Buying Services

You can buy services for yourself or for someone else (for example, recharging another person's phone or paying another household's electricity meter). You are responsible for entering the correct details — phone number, smartcard/IUC number, meter number, betting ID, bank account number, exam type, etc.

Please double-check recipient details before you confirm. Because delivery is near-instant and the underlying provider acts on the details you supply, a transaction sent successfully to the wrong but valid number or account that you entered may not be reversible (see the Refund & Dispute Policy).

6. Pricing, Fees & Cashback

  • Prices for each service are shown in the app before you confirm a purchase. The price you see at confirmation is the price you pay from your wallet.
  • We may charge a service fee on certain transactions; any such fee is shown before you confirm.
  • Prices are set by us and by the underlying providers and may change at any time without prior notice; changes do not affect transactions already completed.
  • Cashback: Eligible completed purchases earn 2% cashback credited to your wallet as prepaid spending value. Cashback is a promotional reward, not a payment, refund, or cash entitlement; applies only to eligible transactions; may be capped, varied, suspended, or withdrawn at any time on a forward-looking basis; and may be reversed if the underlying transaction is reversed, refunded, or found to be fraudulent or abusive.

7. Agents & Resellers (Commissions)

If you are approved as an agent or reseller, you may earn a commission on completed sales you make through the Service, under the rates and rules in your agent dashboard or a separate agent agreement. Commission is earned only on successfully completed transactions; rates may vary by category and change on a forward-looking basis; commission is credited to your wallet as prepaid spending value unless we agree otherwise; and commission may be withheld, reversed, or forfeited for reversed/refunded transactions or for breach of these Terms. Agent status may be granted, declined, or revoked at our discretion.

8. Delivery & What "Successful Transaction" Means

We aim for near-instant delivery and target a 99.9% success rate, but instant delivery is not guaranteed in every case because we depend on third-party providers and networks.

A transaction is a "successful transaction" when the underlying provider confirms that the service has been delivered — for example, airtime/data credited to the target line, an electricity token generated, a cable subscription activated, an exam PIN issued, a betting wallet funded, or a bank transfer accepted by the receiving bank. Some services deliver a confirmation reference, token, or PIN in the app; that record is your proof of delivery.

9. Failed Transactions

If a transaction fails — i.e., the provider does not deliver the service — the amount is automatically refunded to your wallet, typically promptly. Refunds are returned to your wallet balance (the source you paid from), not to your card or bank account, unless we are required to do otherwise.

Where a transaction's status is temporarily unconfirmed/pending with the provider, we may hold it briefly while we confirm the outcome before either completing it or auto-refunding your wallet. Full details are in the Refund & Dispute Policy.

10. Acceptable & Prohibited Use

You agree not to use the Service to:

  • break any Nigerian law or regulation, or facilitate anyone else doing so;
  • commit fraud, money laundering, terrorist financing, or any financial crime;
  • use stolen, unauthorised, or another person's card/bank details;
  • engage in chargeback abuse, fund cycling, or transactions with no genuine purpose other than to extract cashback, commission, or other rewards;
  • resell or distribute the Service outside an approved agent arrangement;
  • buy services on behalf of anyone legally barred from receiving them (for example, betting funding for a minor);
  • interfere with, probe, scrape, reverse-engineer, or disrupt the Service or its security; or
  • impersonate any person or provide false information.

We may investigate suspected misuse, freeze affected wallet value pending review, reverse improperly earned cashback/commission, and report unlawful activity to the relevant authorities.

11. Suspension & Termination

We may suspend or close your account, or limit access to features, if you breach these Terms; we are required to by law, a regulator, or a payment/provider partner; we reasonably suspect fraud, abuse, or security risk; or you ask us to close your account.

If your account is closed and you hold a legitimate, remaining wallet balance that is lawfully yours, we will make it available to you through a supported withdrawal/bank-transfer method, subject to verification, applicable limits and fees, and any lawful hold. You may stop using the Service at any time.

12. Service Availability

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Provider outages, network issues, maintenance, or events beyond our reasonable control may delay or prevent delivery. When delivery cannot be completed, the failed-transaction refund process in Section 9 applies.

13. Third-Party Providers

The actual services (telecom networks, DisCos, cable operators, exam bodies, betting operators, receiving banks, and the payment partner) are provided by independent third parties under their own terms. We are a reseller and are not responsible for the underlying networks or for a provider's own service quality, beyond delivering your order and applying our refund process when delivery fails.

14. Liability (Reasonable Limits for a Reseller)

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under Nigerian law (including for death or personal injury caused by negligence, or for fraud).

Subject to that: the Service is provided on an "as available" basis; we are not liable for losses caused by incorrect details you entered, by third-party provider or network failures outside our control, or for indirect, incidental, or consequential losses; and our total aggregate liability to you for any claim relating to a transaction is limited to the amount of that transaction, and for all claims in any 12-month period is limited to the greater of the total fees you paid us in that period or [NGN cap — to be set].

15. Privacy

We handle your personal data in line with our Privacy Policy and applicable Nigerian data-protection law (including the Nigeria Data Protection Act / NDPR). Please review the Privacy Policy to understand what we collect and why.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will give reasonable notice (for example, in-app or by email) before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms. Changes apply going forward and do not retroactively alter completed transactions.

17. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, and the courts of [governing state, Nigeria] have jurisdiction, without prejudice to any non-excludable consumer rights or to the jurisdiction of the Federal Competition and Consumer Protection Commission (FCCPC) or other competent authority. We encourage you to contact us first so we can try to resolve any issue amicably (see the Refund & Dispute Policy).
